Scale Justice Network, Inc. (“SJN”) is a New York non-profit corporation that provides the following websites and their related mobile applications (each a “Site,” together the "Sites"), such as the following sites and the their derivative versions:

These terms of use (“Terms of Use” or “Terms”) apply to all users of the Sites, including users requesting legal services and users rendering such services (collectively, “Users” or “you”).

Please note these Terms of Use contain a requirement to arbitrate any disputes found in Section 16.

When you use one or more of the Sites you agree to all of the terms listed below. Please read them carefully. Also check these Terms of Use periodically, as SJN may update them from time to time. All updates become effective when posted, and supersede any previous version, whether oral or written.

The version of these Terms of Use currently available at this Site, incorporating by reference any supplemental rules or terms posted on this Site, constitutes the complete statement of the agreement between you and SJN related to the subject matter hereof. This version of the Terms of Use supersedes and merges all prior proposals, understandings, and all other agreements, oral and written, between us relating to the subject matter of the agreement, except to the extent that another written agreement between you and SJN states otherwise.

Updated versions of the Terms of Use will appear on this Site and are effective immediately. Your continued use of this Site after any update constitutes your agreement to be bound by the updated Terms of Use. You are responsible for regularly reviewing the Terms of Use.

1. Use of the Sites does not make you SJN's client

By using one or more of the Sites, you agree that your use of the Sites does not create any attorney-client relationship or any other fiduciary relationship between you and SJN. The Sites may provide information for your reference but do not give you legal advice.

We do not warrant or guarantee that the information on the Sites or provided by SJN’s support staff is accurate or up to date. We do not warrant or guarantee any results based on your use of the Sites. When you use the Sites, you do so at your own risk.

Because the Sites and SJN's support staff are not lawyers, they cannot:

For legal advice about your case, you should see a lawyer or a BIA accredited representative.  Depending on your use of the Sites, forms you generate using a Site may require consultation with a lawyer or a BIA accredited representative prior to signing or filing. Whether you enter into an attorney-client relationship with any lawyer is solely up to you and that lawyer.

Some of the Sites, such as Citizenshipworks, LawHelp Interactive, Reclamo, and Houston Immigration Network, list nonprofit legal service organizations that provide free or low-cost services. Some of the listed legal service organizations have partnered with SJN, allowing them to provide services through one or more of the Sites, while others have not. Should you require legal services, you are free to choose any legal service organization listed on a Site or any non-listed organization of your choice. If you choose a nonprofit partner organization as your legal service organization, you agree that the nonprofit partner organization will be able to access all information you provide to the Site and can contact you directly via email or text message. If the legal service organization you choose is not a nonprofit partner organization, it will not be able to access your information through a Site, and you are responsible for providing your information directly to the legal service organization.

Our lists of legal service organizations are provided solely for your convenience. The legal service organizations are not affiliated with or controlled by SJN, and SJN does not approve, endorse or recommend any particular legal service organization.

Some of the Sites, such as Citizenshipworks, LawHelp Interactive, Reclamo, and Houston Immigration Network, will allow you to further communicate with volunteer attorneys, advocates, and nonprofit partner organization staff members. These nonprofit partner organization staff members, advocates, and volunteer attorneys are not affiliated with or controlled by SJN, and SJN does not approve, endorse or recommend any particular nonprofit partner organization staff member, advocate, or volunteer attorney. Any attorney-client relationship you enter into with a nonprofit partner organization is strictly between you and the respective organization.

By using a Site to interact with a volunteer attorney, an advocate, or a staff member assigned to you by a nonprofit partner organization, you agree to share any information you submit to the Site with the volunteer attorney, the advocate, and/or the nonprofit partner organization. Any advice given to you by a nonprofit partner organization, an advocate, or a volunteer attorney through a Site (for example, through a videoconference through the Site) reflects solely the opinion and advice of the nonprofit partner organization, the advocate, or the volunteer attorney, and not SJN.

We have also partnered with various legal and non-legal organizations to create Partner Portal Pages and Campaigns. If you choose to start an application through a Partner Portal Page or a Campaign, your information will be sent to that partner and they will be able to contact you via email and text message to help with your application process.

3. Not for Commercial Use

Depending on the Site, the Sites were created for:

Unless SJN gives you its written permission, you may not reproduce, copy, change, publish, display, or distribute any part of a Site, except as allowed by the terms of these Terms of Use.

As a general matter, it is not permissible in the United States to practice law without being properly licensed. Use of a Site does not constitute the practice of law. Persons who are not licensed attorneys or accredited representatives are not authorized to use information from the Sites to practice law.

4. User information

To use certain parts of certain Sites, such as Citizenshipworks, Immigration Advocates Network,  LawHelp Interactive, Reclamo, Ready to Stay, and Houston Immigration Network), you may have to provide registration information, including a username (sometimes your mobile number or email) and password. The information you provide must be correct and complete, and you must update it if any of that information changes.

To use a Site, you must agree to, where applicable:

Protect Your Password: To protect your information, your password should not use your name, birthday, address, street name, Social Security number, alien registration number, driver’s license number, a single word, or other information that is easy to guess.

5. No Illegal Activity

SJN may investigate complaints and reported violations. If we suspect illegal or inappropriate activity, we may report it to law enforcement officials, regulators, or other parties. We may disclose user information of anyone or any entity involved in that activity to the extent necessary, including: user profiles, email addresses, usage history, submitted or uploaded materials, IP addresses, and traffic information. If possible, we will take reasonable steps to minimize the disclosure of confidential information of users who are not the target of the investigations, such as by redacting confidential information.

You must not use the Sites in any way that would be considered as illegal under New York law, U.S. law, or the laws of your state.

6. SJN's Ownership Rights

The Sites are protected by copyrights, trademarks, trade dress, service marks, patents, and other proprietary rights and laws. SJN owns its copyrights to the Sites’ layout, graphics, navigation design, source code, the collective and compiled copyrights in its databases, and all other content created by SJN employees, contractors, consultants, and contributors to the Sites.

You may not use or alter any of the information or content on the Sites in any way, except that you may use the Sites and print copies of them for personal, non-commercial use. Any print-outs from the Sites must retain all copyright, trademark, and other proprietary notices.

You may not use, or assist, encourage, or enable any third-party to use, any robot, spider, artificial intelligence system, or other automated device, process, or means to access, retrieve, copy, scrape, aggregate, collect, download, or otherwise index any portion of any content contained on the Sites, except as expressly permitted by SJN in writing.

API access to SJN sites are governed by separate written agreement. Credentials provided for use of the API by a specific organization or individual should not be shared with a third party, used for non-commercial purposes, and should follow the agreement accompanying the use of such APIs

You may not use SJN’s trademarks, service marks, or trade dress in any way, including in:

Anyone that contributes material for publication on a Site hereby grants SJN a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, transferable, and sublicensable license to access, reproduce, distribute, integrate, compile, display, create derivative works of, modify and otherwise use the material for the purposes of publication and distribution and for the internal development, creation, training, and fine-tuning of SJN’s own artificial intelligence models and tools. All contributors that contribute material to a Site represent and warrant that they have all rights necessary to provide such material to SJN for use by SJN pursuant to the license granted in the previous sentence.*

7. Follow SJN's Rules

8. Communications with SJN

If you send us an email, please be advised that the Internet is not a secure method of transmitting information. We shall have no liability for any loss or damage that results from interception and/or unauthorized use by third parties of any information you send by email. 10. Confidentiality

SJN takes reasonable steps to keep your information confidential. For additional information, please review our Privacy Notice.

If you are working with a nonprofit partner organization, advocate, or volunteer attorney through a Site, your volunteer attorney, advocate, and/or administrators from the nonprofit partner organization may be able to access the information you provide at the Site. Only your assigned volunteer attorney, advocate, and/or administrators from the nonprofit partner organization and SJN can access your information, although the nonprofit partner organization will retain a copy of your file.

11. Deletion of Information

If you registered using a mobile phone number, you may send your request by first-class mail, return receipt requested, to the following address: 228 Park Ave S, PMB 90360, New York, NY 10003-1502.

SJN may terminate or suspend your license to the Sites or accounts at any time for any reason, without notice to you. If you do not access your account on some of our Sites within certain time periods, your account and any information you have entered may be deleted.

SJN may also close the Sites at any time for any reason, without notice to you.

Links to our Sites: You may not link to one of our Sites from another website for commercial purposes. Any links to our Sites from other websites that are not part of our organization do not imply any affiliation between SJN and those other websites.

SJN does not guarantee or warrant the Sites or their content to be always available, correct, up-to-date, reliable, or free of viruses or other defects, or that any problems or inaccuracies will be corrected.

Legal Claims and Procedures

14. Limited Liability

BY YOUR USE OF THE SITES, YOU AGREE TO WAIVE ANY AND ALL CLAIMS RELATING TO THE USE OF THE SITES OR THEIR CONTENT, WHETHER SUCH CLAIMS ARE AGAINST SJN OR ANY OTHER PERSON WHO HAS SUPPLIED CONTENT TO THE SITES. UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY SHALL SJN OR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING, OR DELIVERING THE SITES BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY SPECIAL, DIRECT, INDIRECT, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER (INCLUDING, WITHOUT LIMITATION, ATTORNEYS' FEES) IN ANY WAY DUE TO, RESULTING FROM, OR ARISING IN CONNECTION FROM, YOUR ACCESS TO, USE OF, OR INABILITY TO USE, THE SITES. TO THE EXTENT THE FOREGOING LIMITATION OF LIABILITY IS PROHIBITED OR FAILS OF ITS ESSENTIAL PURPOSE, THE SOLE OBLIGATION OF SJN OR ANY OTHER PERSON WHO HAS SUPPLIED CONTENT TO THE SITES TO YOU FOR DAMAGES SHALL BE LIMITED TO $100.00.

15. Indemnification

You agree to indemnify and hold harmless SJN and any third party providing content to the Sites from any and all claims, losses, expenses, damages and costs, including but not limited to reasonable attorneys' fees, arising as a result of your use of the Sites.

16. Arbitration

Please read the following section carefully, as it requires You to arbitrate disputes and claims with SJN and limits the manner in which you can seek relief from SJN. In particular, it requires you to arbitrate disputes with SJN rather than resolve them in court.

Any claims made related to the Sites must be settled in New York by binding arbitration. The arbitration will be conducted in accordance with the then applicable Commercial Arbitration Rules of the American Arbitration Association, to the maximum extent permitted by law. Each side will pay for its own costs, including attorney fees and costs.

If you go to arbitration, your claim will be decided by one arbitrator selected by SJN. The arbitrator's award will be binding and conclusive, and a judgment on any award may be entered in any court having jurisdiction. The arbitrator may not award punitive damages.

Any claim made related to the Sites will be arbitrated on an individual basis and shall not be consolidated with any claim of any other party whether through class action arbitration proceedings, class action proceedings or litigation (if required by applicable law), or any similar proceedings.

17. Jurisdiction

These Terms of Use shall be governed by and construed in accordance with the laws of the State of New York, without giving any effect to any conflicts of laws rules or principles. You agree that any action at law or in equity arising out of or relating to these terms not subject to arbitration or that cannot be heard in small claims court shall be filed only in the state or federal courts located in New York and you hereby consent to the personal jurisdiction of such courts for the purpose of litigating any action.

18. Enforcing SJN's Rights

These Terms of Use shall be governed by and construed in accordance with the laws of the State of New York, without giving any effect to any conflicts of laws rules or principles. You agree that any action at law or in equity arising out of or relating to these terms not subject to arbitration or that cannot be heard in small claims court shall be filed only in the state or federal courts located in New York and you hereby consent to the personal jurisdiction of such courts for the purpose of litigating any action.

SJN and any nonprofit partner organization or other contributor or third party submitting material to the Sites has the right to enforce the following sections of these Terms of Use: Disclaimer (13), Limited Liability (14), Indemnification (15), Arbitration (16), and Enforcing SJN’s Rights (18) against you on its own behalf.

If any part of these Terms of Use is found invalid or unenforceable, SJN and you agree that:

SJN reserves the rights to remove any content that allegedly infringes a third party's copyright or otherwise violates the rights of any third party, or for any reason whatsoever, and to prohibit further use of the Sites by the individuals responsible for said infringement or violation. Additional Terms for Nonprofit Partner Organization Staff, Advocates, Volunteer Attorneys

22. Not-for-Profit Use by Nonprofit Partner Organization Staff, Advocates, Volunteer Attorneys

If not used for profit, the Sites may be used by nonprofit partner organizations, advocates, and volunteer attorneys. Volunteer attorneys are volunteer lawyers who are providing pro bono or reduced fee legal assistance on behalf of a nonprofit partner organization. Advocates are volunteers who provide support but are not lawyers (such as accredited representatives, workshop coordinators, or community advocates).

SJN cannot guarantee that your client’s or your information will be protected from your adversaries.

Caution! Before using email, videoconferencing, or the Sites to communication confidential case or client information, consult your local ethics rules for communicating privileged information via email and the internet.

Additional Terms for Content Contributors (such as Developers)

26. Ownership and Use of Contributed Material

If you contribute material to SJN through the Sites for publication, you license it to SJN for any purpose. That license gives SJN a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, transferable, and sublicensable right to access, reproduce, distribute, integrate, compile, display, create derivative works of, modify, and otherwise use your contributed material and sublicense it to third parties. SJN also has the right to delete, edit, or refuse to post any contributed material you submit without your permission for any reason.

Other users of the Sites may use your contributed material, link to your contributed material, and repost your contributed material on the Sites according to these Terms of Use. They may develop new material or templates based on your original contributed material. Other users do not have the right to copy, share, or change your original contributed material at the Sites without your permission.

You may contribute information to existing material on our Sites that you use to create new material that you may download, store, and print for your personal use, which you use at your own risk, and SJN is not liable for its use.

When you submit contributed material to SJN, we may identify you as the source of any contributed material you submit.

For the avoidance of doubt, contributed material does not include information provided by users of the Sites seeking to obtain our services (such as help filling out immigration forms) but is limited to material contributed for publication.
